These Terms and Conditions apply to all transactions between you and Anode Outlet. They do not affect your statutory rights. Please read them carefully.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.

These Terms and Conditions are governed by English law and are subject to the non- exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.

Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the remainder of these Terms and Conditions.

Customer Orders:

We will treat each order and any payment for goods as an offer by you to purchase the goods subject to these Terms and Conditions.

To order goods over the telephone or on our website you must be at least 18 years of age.

All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail.

By completing and submitting the electronic order form (or proceeding through the ‘checkout process’ and making payment) you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

Neither submitting an electronic order form, completing the checkout process or receiving an email confirmation constitutes our acceptance of your order. Only once goods have been delivered or collected do we formally accept your offer and our contract becomes legally binding.

Where your order is partially delivered or collected, we only formally accept your offer and our contract becomes legally binding on those items delivered or collected.

Until your order is delivered or collected, we reserve the right to cancel all or part of your order for any reason, in which case we will inform you in-person, by telephone or by email. We will process any refund due to you at the time your order is cancelled.

We will tell you if your payment details cannot be authorised for any reason and invite you to pay by an alternative method.

Prices:
The total price payable will be stipulated at the time when you place your order. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, the imposition of any taxes or duties, or, if due to an error or omission, the price published for the goods is wrong whether or not the order has been acknowledged.

We will inform you of the correct price first and give you the opportunity to cancel or continue with the order at the correct price. Our contract is only legally binding when your goods have been delivered or collected.

All product prices are inclusive of VAT, where applicable, but exclusive of delivery charges which will be payable as indicated at the time the order is placed.

From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we will try to offer you an alternative.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store.

We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.

Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will contact you and ask you whether you wish to cancel your order and receive a full and immediate refund, or continue with the order at the correct price. We will not be obliged to supply goods at the incorrect price.

Prices that are reduced for sales and promotions are only valid for the specified period.

Click and Collect:
Click and collect is available on all orders and is subject to availability.

We request that you give us a minimum of 3 working hours (inline with our Opening Hours) after reserving your order before visiting the store to collect your item(s).

If the product you have purchased is not in stock, we will contact you as soon as possible using the details you have given us. However, to avoid any disappointment, we strongly recommend that you telephone us before visiting to collect your purchased item(s) to confirm your order and product availability.

If you buy an item that is not in stock you will have the following choices offered to you:

continue with your order as placed and to collect your item once it is in stock.
an alternative product – you will then either be refunded or required to pay any difference in price between that of the original product ordered and the alternative product as chosen.
to cancel your order and receive a full refund.

Delivery:
This section should be read in conjunction with the Delivery Information page.

You will be informed of the delivery charge before you place your order on most items. However, for certain items of particular size and weight, we will need to price delivery specifically upon the delivery address after checkout has completed – if you would like to know an exact delivery charge please contact us beforehand.

If after checkout we present a delivery charge you are unhappy with we will be happy to cancel your order and issue a full refund immediately. We will never charge you additional postage without confirming with you first.

Free Delivery is available on certain items and is stated on the checkout page. Although some items may attract Free Delivery, on rare occasions Delivery will sometimes need to be charged after checkout depending upon the delivery address, but we will inform you of this before any charge for delivery is made. If we present a delivery charge you are unhappy with we will be happy to cancel your order and issue a full refund. We will never charge you additional postage without confirming with you first.

Where items are in stock and ordered before 1pm on a working day, we will always endeavour to despatch your order on the same day. Where orders are placed at weekends or public holidays, your order will be despatched on the next working day. However, even with the best intentions, mistakes and delays with couriers can occur and so deliveries can, at worst, take up to 21 working days. European and International orders may take longer.

If you wish to cancel your order after it has been despatched, you will be charged for both delivery and collection costs.

If you are unavailable when our delivery partner tries to deliver your order, they may:

try to deliver again the next working day
drop a card in to offer you a collection from a local collection point.
If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any additional costs incurred.

Signature On Delivery:
We require a signature on delivery for all orders, unless specified by you during the order process. If you request that we leave your delivery in a place without obtaining signature, we will rely upon our delivery partner to confirm that delivery was made as specified by you. If you have requested for your order to be delivered without a signature we cannot accept responsibility for your order after our delivery partner has made delivery. Should your order go missing after our delivery partner delivers your order, we will be unable to repeat or refund your order. We therefore strongly suggest you sign for your order.

All quoted delivery prices, unless otherwise stated, are for most UK Mainland addresses as specified by our delivery partners.

Exclusions to “UK Mainland”

Our couriers consider shipments to the following locations as not “UK Mainland” and so will incur additional charges and may also experience delays: Scotland Mainland, Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE), International, European, Northern Ireland (BT), Isle of Wight (PO30-37), Isle of Man (IM)

We will only deliver goods to the address on the order.

Import Duty of Tax:
Please note that if the delivery address is given on an order that is outside of the UK an import tax may be payable upon receipt of the goods. The amount payable depends on the destination and may be subject to charge. These payments are the responsibility of the customer and we accept no liability for the payment which may be due.

Order Processing:
Your order is sent directly to our secure fulfilment system for processing. Once we have received your order and payment, our staff will pick, pack and despatch the item. If there are any problems with your order, we will endeavour to contact you as soon as possible using the contact details you have provided.

You can track the progress of your order at any time by logging into My Account from the Home page on this website.

All transaction information passed between our website and the WorldPay, Stripe or PayPal Payment System is encrypted. No cardholder information is ever passed unencrypted. You can be completely secure in the knowledge that nothing passed to WorldPay or PayPal can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Internationally recognised encryption and data storage:
Once on the WorldPay, Stripe or PayPal system, all sensitive data is secured using the same internationally recognised encryption standards. The encryption keys are held on state-of-the-art, tamper proof systems, making them all but impossible to extract. The data they hold is extremely secure and they are regularly audited by the banks and banking authorities to ensure it remains so.

Private network links to banks:
WorldPay, Stripe and PayPal have multiple private links into the banking network that are completely separate from the Internet, which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Employee access:
No individuals within our company, WorldPay, Stripe or Paypal are able to decrypt transaction information or cardholder data. Their systems only allow access to most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your card information is secure even from their own employees because the systems never display the full card numbers, even on administration screens.

Law:
The laws of England shall govern these Terms and Conditions of Sale and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
